What is an estate plan?

An estate plan is a set of instructions, that are designed to be legally binding, to distribute or manage assets in the invest or your death or disability.  What happens if you die without a valid will?  In Texas as in other states, the law dictates what happens to your estate if you die without a valid will.  This is called “intestacy” and the laws of intestacy determine who gets what.

So when people tell me they don’t have a will I remind them that everyone has a will – either the one they wrote or the one the State provides.  Disability planning is also crucial in the estate planning process.  The same event that can cause your death can also cause you to almost die.  The problem comes when a person cannot legally make financial or medical decisions and has not named a personal representative.  This representative is called an “attorney in fact” and is name in a power of attorney.  The alternative is the State must appoint a guardian if you have not named someone in a power of attorney.    For example, you may need medical attention or have to sign a legal document like a title while you are incapacitated.   A guardianship proceeding requires an attorney and a trip or two to the probate court.
